The Idaho Department of Health and Welfare intends to promulgate rules governing a secure treatment facility for people with intellectual or developmental disabilities and desires public comment prior to initiating formal rulemaking procedures. 

The Secure Treatment Facility Act approved by the 2017 Legislature enables the Department to establish, operate, maintain, and license a secure treatment facility for individuals with intellectual or developmental disabilities who pose a threat or risk to the safety of others, both inside the facility and in the surrounding community. 

This chapter is needed to establish the licensing standards which will provide for the security measures and restrictions needed for this type of facility as well as for the rights and safety of the clients in the facility.
