Administrative Rules

The Board of Health and Welfare is authorized to adopt rules that set standards for the approval of alcohol and substance use disorders treatment and recovery support services, facilities, and programs in the State of Idaho.  Under Sections 56-1003, 56-1004, 56-1004A, 56-1007 and 56-1009 Idaho Code, the Director of the Department is authorized to supervise and administer services dealing with the problems of alcoholism including the care and rehabilitation of persons suffering from alcoholism.

The rules set minimum standards for approved public and private alcohol and substance use disorders treatment or recovery support services facilities and programs in the state.  These programs treat or provide services to persons who use or are substance dependent on alcohol or drugs, including prescription drugs, to the extent that their health is impaired or endangered or their social or economic function is disrupted.

The purpose of the rules is to:

  • Establish requirements for the approval, denial, suspension or revocation of certificates of approval for approved public and private alcohol and substance use disorders treatment and recovery support services facilities and programs in Idaho;

  • Set fees to be charged by the Department for inspections of approved public and private alcohol and substance use disorders treatment and recovery support services facilities and programs in Idaho;

  • Establish criteria for the admission and discharge of persons by approved public and private alcohol and substance use disorders treatment and recovery support services facilities and programs in Idaho; and

  • Establish requirements for health, safety, quality of treatment, care and services provided by approved public and private alcohol and substance use disorders treatment and recovery support services facilities and programs in Idaho.
